Second woman alleges sexual battery by masseuse

A second victim has come forward alleging sexual battery by a former Laguna Beach Massage Envy male masseuse.

In the civil complaint filed March 20, the new defendant, known as Jane Doe No. 2, alleges that Mark Pergil Valenzon, 35, placed his erect penis on her head and against her bare side during a February 2011 visit.

Valenzon is also facing a civil suit and criminal charges of attempted forcible rape and intent to commit a sexual offense against another woman, known as Jane Doe No. 1.

Scott J. Ferrell of Newport Trial Group is representing both women in their civil suits.

Jane Doe No. 2 alleges that Valenzon began breathing heavily and masturbated during her massage, according to court records.

"Paralyzed in fear and disbelief, plaintiff lay still on the massage table," the complaint reads.

Valenzon then proceeded to touch her with his erect penis, according to the complaint. Valenzon left the room immediately after the massage was over, and the plaintiff approached a staff member and told her she never wanted to have Valenzon as a masseuse again. The staff member made a note in the computer system.

In May or June of 2011, Jane Doe No. 2 said she heard of the attempted rape of another customer, in which Valenzon was a suspect, and she decided to come forward, according to the complaint.

The plaintiff requested a copy of her file at Massage Envy that noted her request and found out that the file had been deleted. The complaint asserts that the file was deleted to cover up any evidence that Valenzon had been a threat to female customers.

Jane Doe No. 2 is claiming intentional infliction of emotional distress, negligent infliction of emotional distress, violation of right to privacy, assault and battery, negligence, negligence per se, premises liability, and negligent hiring, supervision or retention.

The Coastline Pilot previously reported on Jane Doe No. 1's civil suit against Valenzon, Massage Envy and the location's owners, John and Barbara Meeks, before criminal charges were filed by the Orange County district attorney's office.

On Feb. 17, Valenzon pleaded not guilty to charges of attempted forcible rape, assault with intent to commit a specified felony offense and touching an intimate part of another person.

A pretrial for the criminal charges against him is scheduled for April 13 at the Harbor Justice Center in Newport Beach.
